MOTOGO | Hong Kong Motor Club Membership Terms and Conditions

A. Loyalty Program

1. The MOTOGO | Hong Kong Motor Club is a loyalty program (the “Program”) managed and operated by Dah Chong Hong Holdings Ltd (“HKMC”), and is governed by the terms and conditions set out herein (“Terms and Conditions”).
2. The submission of an application for membership to the Program is deemed to be an acceptance of these Terms and Conditions.
3. Upon becoming a member of the Program (the “Member”), the Member shall be deemed to have agreed to and be bound by these Terms and Conditions

C. Membership

1. Any individual aged 16 or above is eligible to apply for Membership.
2. Approval of application for Membership and grant of the relevant Membership shall be at the sole and absolute discretion of HKMC. HKMC may refuse to approve and grant any Membership without giving any reason.
3. Members must register a correct and valid mobile number from Hong Kong, Mainland China, Macau or Taiwan. Members must be the legitimate owner of the registered mobile number.
4. Each mobile number can only be registered by one Member. Duplicate registrations of the same mobile number is not acceptable. HKMC shall have the right to, without any prior notice, immediately (i) suspend or terminate such Membership; (ii) forfeit all MOTOS and Benefits of that Member; and (iii) cancel the Member’s rights of further Benefit redemption.
5. Members must ensure that the information submitted during sign-up is authentic, accurate, complete, not misleading and without any elements of Fraud.
6. HKMC takes no responsibility for any undelivered SMS, push notifications, emails or other instant messages.
7. Membership and the Benefits are non-transferable and non-assignable and may only be used or enjoyed by that Member to whom the Membership and the Benefits are granted or issued.
8. Membership has lifetime validity period unless terminated pursuant to the Terms and Conditions.
9. HKMC may at any time without prior notice review the Membership Tiers and the criteria for eligibility to the Membership, or reassign a Member to another Membership as HKMC may decide.
10. HKMC is entitled to modify the structure, benefits, contents and other features of the Program, including but not limited to the mobile application, website, the Memberships, Membership Tiers, Net Spending Amount, the Benefits, these Terms and Conditions and termination of the Program, at any time without prior notice. Although HKMC will use reasonable efforts to notify Members of material changes to the Program and/or to these Terms and Conditions, it is the responsibility of Members to keep themselves up to date in respect of the Program and these Terms and Conditions. Any activities on E-Platform and/or earning and/or use of MOTOS will be deemed as acceptance of any such modification. HKMC will not be liable for any loss or damage resulting from any modifications to the Program, including but not limited to these Terms and Conditions.
11. Each Member will be assigned a Membership account with a unique Membership number. Member must ensure that his/her Membership account details including but not limited to the password and Membership number are kept confidential and are not disclosed to any parties. Member is fully responsible for any use of his/her Membership account by any persons and HKMC shall not be liable in the event that a third person obtains access to a Member’s account to make transactions, whether with or without authority of the Member.
12. HKMC shall have the right to audit a Member's account at any time without prior notice to the Member to ensure compliance with these Terms and Conditions. During the course of an audit, a Member’s account may be temporarily suspended and a Member may not be permitted to access his/her account, perform any transactions, earn and/or use MOTOS or enjoy any Benefits.

D. Membership Tiers

1. There are five (5) tiers of Membership, namely, in the order of tiering under HKMC from low to high tier, Blue (“Blue”), Silver (“Silver”), Gold (“Gold”), Platinum (“Platinum”), Diamond (“Diamond”).

3. Membership Year
   12 month period from the day the Member joins the Program or from the day the Membership Tier is upgraded, downgraded or renewed. The last day of the Membership Year is the last calendar day of the 12 month.
   
   For example:
   1. Member joins the Program as a Gold Member on 15 Jan 2025, his/her Membership Year is valid from 15 Jan 2025 to 31 Jan 2026.
   2. Member joins the Program as a Gold Member on 15 Jan 2025, and s/he became a Platinum Member on 15 Feb 2025, his/her Platinum Membership Year is valid from 15 Feb 2026 to 28 Feb 2026.
       
4. Membership Tier Upgrade/Downgrade
   1. If a Member has fulfilled the Requirement for the next immediate Membership Tier as listed below within Membership Year, his/her Membership Tier will be automatically upgraded to the next immediate tier within 30 days from the date s/he fulfils all Requirements, and his/her Accumulated Spending will be reset to 0.
   2. If a Member has not fulfilled the Requirements for the next immediate Membership Tier but has fulfilled the Requirements of his/her current Membership Tier within Membership, his/her Membership Tier will remain the same and be extended for 12 months.
   3. If a Member has not fulfilled the Requirements of his/her current Membership Tier within Membership Year (except for Diamond Members), his/her Membership will be automatically downgraded to a lower tier, according to the Membership Tier which s/he has fulfilled the Requirement, from next Membership Year.
   4. Blue to Platinum will only be upgraded to Diamond if the Member fulfills the entry requirement as stated in clause D2.
   5. Accumulated Spending will be reset to 0 on the first day of every Membership Year.

For example:

1. An individual who joined as/became a Blue Member on 1 Jan 2025, and his/her Accumulated Spending is HK$8,800 as of 15 Mar 2025, s/he will be automatically upgraded to be a Silver Member within 30 days from 15 Mar 2025.
2. An individual who joined as/became a Gold Member on 1 Jan 2025, and his/her Accumulated Spending is HK$33,000 as of 15 Mar 2025, s/he will be automatically upgraded to be a Platinum Member within 30 days from 15 Mar 2025.
3. An individual who joined as/became a Gold Member on 15 Jan 2025, and his/her Accumulated Spending is HK$8,800 as of 31 Jan 2025, s/he will be downgraded to a Silver Member from 1 Feb 2026.
4. An individual who joined as/became a Gold Member on 15 Jan 2025, and his/her Accumulated Spending is HK$3,000 as of 31 Jan 2025, s/he will be downgraded to a Blue Member from 1 Feb 2026.
5. An individual who joined as/became a Diamond on 1 Jan 2025, and his/her Accumulated Spending is HK$100 as of 31 Dec 2025, s/he will still be a Diamond Member.

E. E-Platforms

The E-Platforms included in the Program are as follows. HKMC refers the right to review the list of eligible pages / sections of the E-Platforms at any time without prior notice.

F. Shopping at E-Platform

6. Products, promotions and offers available on E-Platform are exclusive to Members. Members have to login before enjoying any offers or Benefits.
7. The minimum order value on E-Platform is HK$20 after any discounts from MOTOS, promotion codes, discount codes, physical coupons, e-coupons, physical vouchers, e-vouchers and/or e-dollars.
8. All confirmed orders and delivery method cannot be changed or cancelled.
9. All Products, promotions and offers are with limited quota and are available on a first-come-first-served basis, while stock lasts.
10. Products sold cannot be returned or refunded.
11. Products sold cannot be redeemed or exchanged for cash, MOTOS, other coupons or vouchers, other loyalty points or any other rewards.
12. All inventory supply of Products is subject to HKMC. HKMC reserves the right to cancel any order if the selected Product(s) is/are out of stock.
13. Products may carry different validity period and are subject to the terms and conditions of Merchants. Lost, amended, damaged or expired Products will not be re-issued or replaced.
14. Any lost, amended or damaged physical or electronic coupons, vouchers, promotion codes, discount codes, redemption codes, Benefits or the like distributed by HKMC to the Members will not be re-issued or replaced under any circumstances.
15. Each Product shall have specific delivery/redemption method. Please refer to terms and conditions of the corresponding Product for details.
16. In the event where HKMC is not the service provider of the Product, the corresponding warranty shall be subject to the terms and conditions stipulated by the respective Merchant. HKMC shall not be liable for the quality and delivery of the Products in anyway.
17. In case of any disputes between the Member and the Merchants, the parties shall resolve the dispute amongst themselves. HKMC shall have the right not to be involved in the dispute and the exercise of such right by HKMC shall not prejudice any rights of HKMC under these Terms and Conditions.
18. IN CASE OF DELIVERY BY HKMC, THE RISKS SHOULD BE BORNE BY CUSTOMERS FOR LOSING THE DELIVERED PRODUCT UNDER ANY CIRCUMSTANCES. HKMC WILL NOT BEAR ANY LOSS DUE TO DELAYED OR MISSING DELIVERY.
19. The delivery arranged by HKMC is usually made through SF Express. The shipping rate will be determined according to the parcel’s actual weight or the volumetric weight, whichever is greater. Please refer to https://bit.ly/sf_expressrates for details.
20. Under normal circumstances, the Member will receive a status and arrangement update of the order within 14 days from the order confirmation day.
21. After the Group Order cut-off day, if the total order quantity of the Group Order Product has reached the target, the discount amount (rounded down to the nearest HK$0.01) will be refunded to Member’s original payment method within 90 days from the Group Order cut-off day.
22. HKMC WILL NOT BEAR ANY RESPONSIBILITY IN ANY CASE OF NETWORK PROBLEMS, SYSTEM MALFUNCTIONING, POOR PHONE RECEPTION OR BLOCKING BY THIRD PARTY APPLICATIONS THAT CAUSE THE DELAY, LOSS, MISTAKE OR CORRUPTION OF ANY INFORMATION TRANSFER, OR THE FAILURE OF THE ORDER/TRANSACTION OR ANY OTHER ISSUES RELATING TO THE ORDER/TRANSACTION.

G. MOTOS

1. Members may, subject to these Terms and Conditions, earn MOTOS based on his/her Net Spending on E-Platform.
2. Unless otherwise specified, a Member shall earn relevant MOTOS under the Program based on his/her respective Membership tier under the Program at the time of Eligible Transaction.
3. MOTOS earning ratios for each Membership Tier on E-Platform are as follows:

4. MOTOS earning ratios may be adjusted and the number of MOTOS a Member will earn in each Eligible Transaction may be limited by HKMC at any time without any prior notice.
5. MOTOS earned from Net Spending has a validity period of 12 months from the date of issuance.
6. HKMC may, from time to time, launch other campaigns, promotions or initiatives (the “Campaigns”) where Members may earn and/or redeem MOTOS from. The MOTOS earned and/or redeemed from these Campaigns may carry different validity period and are subject to the Campaigns’ respective terms and conditions.
7. MOTOS cannot be sold, bought, transferred, or moved to other accounts.

H. Use or Redemption of MOTOS

1. MOTOS may be redeemed for e-cash on E-Platform during check-out with a minimum redemption amount of 500 MOTOS, and the redemption should be with a multiple of 500 MOTOS.

3. Any expired, unredeemed or unused MOTOS will not be extended, refunded, re-issued or exchanged for cash or MOTOS.

I. Redemption and Enjoyment of Benefits

1. Welcome offer, if any, is applicable to Members upon successful registration. Each Member is entitled to the welcome offer once only. HKMC shall have the absolute discretion to determine the Member’s entitlement to the welcome offer based on the member’s records with HKMC and the Program.
2. No welcome offer (if any) will be given to any individual whose Membership has been cancelled for whatever reason within 12 months.
3. A Member may only claim Benefits at designated locations as may be specified by HKMC from time to time and HKMC is entitled to make the final decision on such Benefits. Members shall be subject to the terms and conditions as may be applicable to any Benefits from time to time.
4. All Benefits are offered subject to availability and are offered on a first-come-first-served basis while stock lasts, if applicable.
5. A Member is entitled to Benefits only when his/her Membership account is valid and in good standing as recognized by HKMC.
6. Once HKMC has accepted any redemption request from a Member, the redemption request by the Member cannot be changed or cancelled.
7. In case of any disputes between the Member and any Merchants who provide the Benefits, the parties shall resolve the dispute amongst themselves. HKMC shall have the right not to be involved in the dispute and the exercise of such right by HKMC shall not prejudice any rights of HKMC under these Terms and Conditions.
8. HKMC and/or Merchants who provide the Benefits has the right to verify that the name of the Member on the Member Card is the same as that of his/her official identity document, in order to grant Member the enjoyment of the Benefit(s).
9. HKMC shall not be liable for any loss or damage incurred, (including but not limited to indirect or consequential loss) or for personal injury sustained as a result of taking or using any of the Benefits.
10. Specific terms and conditions may apply to each Benefit.

J. Termination or Suspension of Membership

1. Members may terminate their Membership at any time by email notice to HKMC.
2. HKMC is entitled to forthwith terminate or suspend the Membership of any Member in case the Member breaches any provisions of these Terms and Conditions or does not comply with the instruction of HKMC. In addition, HKMC shall have the right to forthwith terminate or suspend the Membership of any Member at any time at the sole and absolute discretion of HKMC without any reasons or compensation. HKMC shall not be liable for any loss or damage resulting therefrom suffered by any party in any circumstances.
3. HKMC is entitled to cancel all Accumulated Spending, MOTOS and Benefits of a Member forthwith upon termination of his/her Membership for whatsoever reasons without any compensation.
4. Termination of Membership for whatsoever reasons shall not prejudice any accrued rights and remedies of HKMC as of the date of termination.
5. If there is any misuse or abuse of, amongst others, the Membership Cards, Membership accounts or Benefits, HKMC shall have the right to terminate or suspend the Membership or withdraw the Benefits from the Member without prejudice to any accrued rights and remedies of HKMC against the Member.
6. Upon death of a Member, his/her Membership account shall be closed and all Accumulated Spending, MOTOS and Benefits, if any, shall be cancelled by HKMC without any compensation.
7. If a Member has earned and/or redeemed MOTOS and/or Benefits for himself/herself or others through Fraud then the Member shall without limitation be liable to HKMC or the service provider of the Benefits for the full price of the MOTOS and/or Benefits obtained together with all costs and damages incurred or suffered by HKMC or the service provider of the Benefits as a result thereof.

K. Disclaimers and Exclusions of Liabilities

1. HKMC SHALL NOT BE LIABLE TO MEMBERS FOR ANY DIRECT, INDIRECT OR CONSEQUENTIAL LOSS, DAMAGE OR EXPENSE OF ANY KIND WHATSOEVER ARISING OUT OF OR IN CONNECTION WITH THE PROGRAM (INCLUDING BUT NOT LIMITED TO THE REFUSAL BY HKMC OR THE SERVICE PROVIDER OF ANY BENEFITS TO ALLOW ANY MEMBER TO CLAIM ANY BENEFITS OR OTHER BENEFITS). SUCH EXCLUSION OF LIABILITY APPLIES WHETHER THE LOSS, DAMAGE OR EXPENSE IS CAUSED BY NEGLIGENCE OR OTHERWISE, AND WHETHER HKMC HAS ANY CONTROL OVER THE CIRCUMSTANCES GIVING RISE TO THE CLAIM OR NOT.
2. ALL LIABILITY, IF ANY, ON THE PART OF HKMC, ITS EMPLOYEE, AFFILIATES, AGENTS, SUPPLIERS AND PARTNERS, EXPRESSED OR IMPLIED BY STATUTE OR OTHERWISE, ARE HEREBY EXCLUDED TO THE FULLEST EXTENT PERMITTED BY LAW. WITHOUT PREJUDICE TO THE FOREGOING, THE MAXIMUM LIABILITY OF HKMC TO ANY MEMBER SHALL NOT EXCEED HK$100 IN AGGREGATE IN ANY EVENT.
3. A MEMBER IS HEREBY DEEMED TO HAVE READ, UNDERSTOOD AND AGREED TO THESE TERMS AND CONDITIONS, AND CONFIRMS THAT S/HE HAS NOT RELIED ON ANY STATEMENT, REPRESENTATION, ASSURANCE OR WARRANTY MADE BY HKMC AND SHALL WAIVE ALL OF HIS/HER RIGHTS, IF ANY, AGAINST HKMC IN RELATION THEREOF.
4. WITHOUT PREJUDICE TO J.3 HEREINABOVE, HKMC DOES NOT GIVE ANY WARRANTY FOR THE QUALITY OR FITNESS OF ANY OF THE BENEFITS AND ACCEPTS NO RESPONSIBILITY IN RESPECT OF THE FOLLOWING:
   1. REFUSAL BY HKMC OR THE SERVICE PROVIDER OF THE BENEFITS TO OFFER ANY OF THE BENEFITS;
   2. UNAVAILABILITY OF ANY OF THE BENEFITS;
   3. REFUSAL OF REPLACEMENT OR CHANGE OF ANY OF THE BENEFITS OR COMPENSATION OR REWARD THEREOF BY HKMC OR THE SERVICE PROVIDER OF THE BENEFITS.
5. HKMC SHALL NOT BE LIABLE FOR ANY LOSS ARISING FROM THE FAILURE BY ANY MERCHANTS TO PROVIDE ANY PRODUCTS, SERVICES OR BENEFITS. WHERE A MEMBER USES THE PRODUCTS OR SERVICES PROVIDED BY A MERCHANT AS A REWARD, THE RESPECTIVE MERCHANT’S TERMS AND CONDITIONS SHALL APPLY IN ADDITION TO THESE TERMS AND CONDITIONS AND HKMC SHALL NOT BE LIABLE FOR ANY LOSS ARISING THEREFROM.
6. ALL TERMS EXPRESSED OR IMPLIED BY STATUTE OR OTHERWISE ON THE PART OF HKMC ARE HEREBY EXCLUDED TO THE FULLEST EXTENT PERMITTED BY LAW. For the avoidance of doubt, nothing in these terms and conditions shall exclude liability for death or personal injury caused by negligence.

L. General Conditions

1. HKMC shall deal with all personal data in accordance with the Personal Data (Privacy) Ordinance of the laws of Hong Kong. Please refer to the Privacy Policy Statement of HKMC here: https://mymotogo.com/en/disclaimer .
2. A Member shall consent to the Personal Information Collection Statement of HKMC during the application for Membership which sets out the privacy policy and practices of HKMC in respect of its collection, holding and use of personal data in relation to the Program.

4. The use of the MOTOGO | Hong Kong Motor Club website and mobile application is governed by the applicable terms and conditions and the Privacy Policy Statement of the MOTOGO | Hong Kong Motor Club website and mobile application.
5. HKMC SHALL HAVE THE RIGHT AND DISCRETION TO AMEND, DELETE, MODIFY AND/OR VARY ANY OF THESE TERMS AND CONDITIONS, INCLUDING BUT NOT LIMITED TO IMPOSING ADDITIONAL TERMS IN RESPECT OF THE MEMBERSHIP, THE ACCUMULATED SPENDING, THE BENEFITS AND OTHER MATTERS IN RELATION TO THE PROGRAM FROM TIME TO TIME WITHOUT PRIOR NOTICE. Should there be any inconsistencies between these Terms and Conditions and those additional terms and conditions, those additional terms and conditions shall prevail.
6. HKMC is entitled to transfer, assign, charge, sub-contract or otherwise dispose of any of the rights or obligations under these Terms and Conditions and the Program on such terms and conditions as HKMC may at its sole and absolute discretion think fit at any time without any prior notice to the Member.
7. HKMC IS ENTITLED TO AMEND, SUSPEND AND TERMINATE THE PROGRAM AT ANY TIME WITHOUT ANY PRIOR NOTICE, REASON OR COMPENSATION. HKMC SHALL NOT BE LIABLE FOR ANY LOSS OR DAMAGE RESULTING THEREFROM BY ANY PARTY IN ANY EVENT.
8. Any failure to enforce a particular term herein by HKMC does not constitute a waiver of that term.
9. All parties agreeing to these Terms and Conditions do not intend that any term of these Terms and Conditions should be enforceable or enjoyed, by virtue of the Contracts (Rights of Third Parties) Ordinance (Cap 623 of the Laws of Hong Kong), by any entity or person who is not a party to these Terms and Conditions. The consent of any entity or person who is not a party to these Terms and Conditions is not required or rescind or vary these Terms and Conditions.
10. HKMC has the right to interpret these Terms and Conditions and its interpretation shall be final and binding on all parties concerned.
11. In the event of any discrepancy between the English version and the Chinese version of these Terms and Conditions, the English version shall prevail.
12. These Terms and Conditions shall be governed by the laws of Hong Kong and any disputes arising from, out of or in relation thereto, shall be subject to the exclusive jurisdiction of the Hong Kong courts.
